We assist patent counsel with technical issues.

In addition to our marketing consultancy, we act as a technical advisor to companies and their patent counsel. In this role, we research technical issues as they relate to specific intellectual property matters. Our findings help counsel understand the technical aspects of the matter and hence build a better case.

Prior Art Searches. Prior art is crucial to many patent matters. While some prior art can be found using commercial search services, there is no substitute for the knowledge of someone with experience in the field. We have provided prior art in a number of computer-telephony and VoIP matters. In one such case, a patent was successfully invalidated. In another, a defendant successfully defeated a claim of infringement. In yet another, a defendant was able to negotiate a much reduced license fee.

Patent Valuations. Commercial valuations of patents are needed when patents are licensed or sold. These valuations depend on many factors, including the range of technically feasible and commercially interesting applications and the size of the applicable market segments. We have provided analyses of such factors to major international corporations and their patent counsel to support purchase, licensing and sale negotiations.

Technical Review of Patent Applications. We have direct experience with the technical content of patent applications. While he was at Intel, Carl Strathmeyer was named as co-inventor on ten issued United States patents. In each of these matters, Carl was the lead technical representative who drafted the initial specification and worked with inside and outside patent counsel to revise and file the application. Carl's familiarity with technical, business and legal issues makes this process as efficient as possible.
